Botched Colonoscopy Caused Serious Injury, Lawsuit

Doctor working

A colonoscopy is typically regarded as a somewhat routine procedure that should be considered safe. This was not the case for one man, who claims he was seriously injured by the doctor during a colonoscopy procedure. The man filed a medical malpractice lawsuit naming the doctor and practice seeking damages in excess of $50,000. According to the documentation, the man suffered a perforated colon and bladder during the operation.

Colonoscopy

A colonoscopy is an endoscopic examination of the large bowel. It is a procedure that is recommended for older individuals since it can find pre-cancerous polyps and abnormalities that would otherwise go undetected. The test is widely used as a way to screen for cancer. During the test a thin colonoscope is inserted into the colon. An attached fiber optic camera is used to examine the inside of the colon including the large intestine and usually a portion of the small intestine. If a small polyp is found, it can often be removed immediately.

Colonoscopy Complications

While a colonoscopy is a rather standard procedure, there can be complications, particularly if the doctor does not use proper care. In this instance, the lawsuit states that after the procedure the man complained of pain but was told that it was normal. Actually, the man had suffered a perforated colon and bladder which later required surgical repair. It was determined that he had a colovessical fistula caused by the colonoscopy. Even though the patient reported pain and symptoms immediately following the procedure, the doctor was negligent by not quickly diagnosing and treating them.

Medical Malpractice

When a doctor or other medical professional makes a mistake it is often considered medical malpractice. Doctors are required to provide proper care based on their advanced training, experience, and expertise. Patients should be able to count on receiving the best care, diagnosis, and treatment from their doctors and other medical practitioners. When a doctor makes a mistake or fails to provide proper treatment, a patient may be entitled to compensation. Medical malpractice cases require plaintiffs to prove four main elements including that the doctor was liable for duty of care and also violated that standard of care. Also, proof of the injury must be provided along with proof that the injury was caused by the negligence of the doctor.

Lawsuit Filed

In this case, the man suffered a severe injury that was caused by the negligent actions of the doctor. The patient sought medical treatment from another physician, who properly diagnosed and treated the situation. The man required surgery and other medical treatment to repair the injuries. His injuries could have been less severe if the symptoms were more quickly diagnosed. Luckily, the man recovered from these serious injuries. The lawsuit seeks recovery of medical expenses, money for pain and suffering, and for other damages, as well as the legal fees associated with the lawsuit.
