Aperion Care is a large network of skilled nursing, assisted living, rehabilitative, and mental health facilities with locations throughout the Midwest. While many of these facilities hold above average ratings with Medicare.gov for their level of care and staffing, there are also a large number of facilities performing at below and much below average with severe health violations and poor staffing numbers— Aperion Care Marseilles is one of the latter.

05/18/2018 Failure to ensure that a nursing home area is free from accident hazards and provides adequate supervision to prevent accidents. A resident suffered a severe facial injury when their gown was caught in a wheelchair wheel, pulling them forward onto their face. A CNA was transporting the resident from the shower when the resident’s gown caught in the wheelchair wheel, causing the resident to fall forward, causing open fractures to their nose in multiple places, requiring 13 sutures.
05/18/2018 Failure to try different approaches before using a bed rail. If a bed rail is needed, the facility must (1) assess a resident for safety risk; (2) review these risks and benefits with the resident/representative; (3) get informed consent; and (4) Correctly install and maintain the bed rail. Upon observation and record review, it was found that 9 residents had bed rails in use, limiting their bed mobility, with no record of other interventions previously attempted.
03/30/2018 Failure to protect each resident from all abuse, physical punishment, and being separated from others. A resident was hit in the face with a support cushion and threatened by a staff member. The CNA picked up a support pillow and hit the resident in the face. The CNA then threatened that if the resident fell on the floor, the CNA would not pick them up. The CNA then smashed the pillow in the resident’s face and hit the resident a few times before wheeling them to the dining room and leaving them there.
How You Can Protect Your Loved One?

- Choose a well-rated nursing home – Don’t assume that all nursing homes are the same, or that it “looks” nice enough. Read reviews online, learn what other families are saying their experience has been, and find the facilities’ rating with Medicare. You can find this information as well as health inspection reports via medicare.gov.
- Tour the facility – Most facilities have scheduled tour days where they allow potential clients to see what they have to offer. Keep in mind that they will be 100% prepared for guests— they’ll be putting their best foot forward. Make an effort to visit again on a day when they are not expecting guests before you make a commitment.
- Stay connected and be aware – Once you have place your loved one in nursing home care, stay in touch and visit as often as you realistically can. You shouldn’t be in a constant state of worry, but do be aware of signs of neglect or abuse.
- Document everything – If you do suspect your loved one is being neglected or abused while in nursing care, be sure to document everything you find suspicious.
Signs of Abuse or Neglect
Unfortunately, even in the best rated nursing homes, neglect and abuse can still occur. Many times, you loved one can’t or won’t communicate that there is a problem. Here are some signs to watch for:
- Weight loss not due directly to an illness
- Frequently misplaced or lost personal items
- Unusual behavior – violent, withdrawn, depression
- Frequent visits to the emergency room
- Untreated, severe, or new bedsores
- Unexplained injuries – bruises, scrapes, burns
- Evidence of dehydration like sunken cheeks or eyes
- Wrong type or the wrong amount of medication administered
- Poor hygiene, dirty living space
- Instances of wandering or elopement
How to Take Action
If you feel your loved one is the subject of abuse or neglect, take immediate action by following the steps outlined below. Your loved one’s safety (and possibly the safety of others) is at stake.
- Document. Make detailed notes of times, dates, individuals involved, and take pictures if you feel they help the credibility of your concern.
- Discuss. Take your concerns up with the administration of the facility. You have the right to ask questions about your loved one’s care, and they should be willing and ready to answer. Document their response, positive or negative.
- Follow up. If the administration made claims that they were going to resolve your concerns, follow up and be sure they have done so. If they were not responsive initially, or do not respond satisfactorily, it may be time to seek legal action.
