Aperion Care of Midlothian
Americans are living longer than ever before. With 15% of the American population over the age of 65 today, and this number steadily climbing, the search for quality elder care is also growing. When the need for nursing home care arises, we expect our loved ones to be cared for respectfully and professionally, with their medical and daily life care needs taken care of so they can recuperate and live comfortably.
We shouldn’t have to worry if our grandmother is receiving the right medicine, if our father is being supervised so he doesn’t fall again, or if our aunt is sitting in her own urine, waiting hours to be changed.
We shouldn’t have to worry, but unfortunately, staffing numbers are kept intentionally low to increase profit. Hours are given to minimally qualified, low-paid staff members rather than more experienced, highly-paid professional nurses. Thus, the quality of care suffers. Even in generally well-rated nursing homes, staffing numbers that trend low can lead to serious failures in care.
At Levin & Perconti, we have made it our mission to fight for those that are receiving sub-par care in Illinois nursing homes. We share the facts about these facilities, including their recent health violations, helping you the consumer see beyond the advertisements, and hold these poor performing facilities accountable for their failures in care.
While many Aperion Care nursing home facilities are staffed at average levels, and generally rated above average by Medicare.gov for their level of quality care, far too many of their facilities are performing at below average (or even much below average) levels.

Aperion Care Midlothian is rated “much below average” by Medicare.gov, with below average health inspection reports and 25 complaints that resulted in citations in the past three years. Staffing levels are well below average, with residents receiving half the Registered Nurse, Nurse Aide, and therapy time than the national average, less than an hour of total care time per resident per day. Some of their recent care violations are as follows:
07/13/2018 Failure to make timely report of suspected abuse, neglect, or theft and report the results of the investigation to proper authorities. With known policies of reporting unexplained injuries in place, a record review showed a “new skin concern” to a resident’s lower right wrist with no notification of administration, doctor, of family, and no further investigation made.
07/13/2018 Failure to ensure drugs and biologicals used in the facility are labeled in accordance with currently accepted professional principles; and all drugs and biologicals must be stored in locked compartments, separately locked, compartments for controlled drugs. Upon review of medication carts, the surveyor found multiple expired and unlabeled medications and supplements (no marking made for opening or expiration/discard date.) which if administered could have unknown effects.
07/13/2018 Failure to honor the resident’s right to a safe, clean, comfortable and homelike environment, including but not limited to receiving treatment and supports for daily living safely. Water damage to multiple areas including in bathrooms and ceilings in resident rooms, water damage to brick exterior, and crumbling drywall were noted.
Ants entering the building through a large crack in the wall. Missing and broken tiles and tub handles. Cracks in the tub, missing shower floor tiles, missing drain cover in shower leaving a dangerous hole for a drain, reports of water backups in the shower. Administration stated they had a period of about 4 months with no maintenance director on staff. No maintenance work orders were on file in regard to the major issues observed.
When care violations like these occur, the attorneys at Levin & Perconti hold the facilities responsible for their actions, getting compensation for the affected families, including those who have lost a loved one as a result.
Signs of nursing home neglect and abuse can vary from obvious to less evident; unexplained marks and bruises, weight loss, personality changes, regularly dirty undergarments, among others. We have seen a wide variety of nursing home neglect and elder abuse cases in our number of years experience in the field. These cases have included matters such as:
- Falls, Improper Transfers, Drops by Staff
- Pressure Sores, Bed Sores and Other Skin Ulcers
- Medication Misuse and Errors
- Physical or Sexual Assault of Abuse
These are life-altering events that should never happen to anyone. If you are concerned that your loved one may be the subject of abuse or neglect, start by documenting your observations and asking questions. You have the right to know about the treatment of your loved one, and if the facility staff and administration don’t provide you with satisfactory answers and results, it’s time to act.

Not only were they so professional but also so caring and thoughtful. It was very difficult going over the facts in our mother's case but they were so compassionate and understanding and allowed us to be with them every step of the way. We were able to sit in on the depositions and we were really able to see how hard they worked on our behalf.
