Aperion Care Toluca is a 104-bed skilled nursing, short term rehabilitation and physical therapy facility in Toluca, IL. They offer 24-hour skilled nursing care, as well as physical, occupational, and speech therapy available 7 days per week in a serene, rural setting.
Aperion Care Toluca is rated “much below average” by medicare.gov, and as is common among Aperion Care facilities, staffing is a major issue. Residents receive just 22 minutes of RN care per day, and 3 minutes of physical therapy, less than half the Illinois average. This facility has paid over $12,000 in federal fines in the past three years as a result of care violations. Some of their recent care violations have included:
04/07/2017 Failure to 1) Hire only people with no legal history of abusing, neglecting or mistreating residents; or 2) report and investigate any acts or reports of abuse, neglect or mistreatment of residents AND Develop policies that prevent mistreatment, neglect, or abuse of residents or theft of resident property. Documents state that a resident accused another resident of attacking them in their sleep the night before. The RN stated she notified the administrator and moved the resident that was allegedly attacked to a different room.
Administration could not provide any indication of investigation or reporting to state agency. Other records indicate that criminal background checks were not initiated for a large number of residents.
05/01/2018 Failure to protect each resident from the wrongful use of the resident’s belongings or money. The facility failed to ensure that misappropriation of resident funds did not occur. Upon review of a residents’ bank statements, large sums of money had been withdrawn from their account, totaling over $2,000.
A police investigation revealed that a CNA that had access to the residents’ purse and checkbook were identified.
07/12/2018 Failure to provide pharmaceutical services to meet the needs of each resident and employ or obtain the services of a licensed pharmacist. A resident had not been receiving a medication since 5/2/18. An LPN verified that pre-authorization is needed before the pharmacy will send the medication.
The resident offered to pay out of pocket for the medication, but was told no, it was the facility’s responsibility. The LPN also verified that the pre-authorization had not been followed up on.
What You Should Look For
The signs of nursing home abuse vary greatly and can often take different forms. While you may think of abuse as primarily causing obvious, intentional, physical pain or injury, there are many different ways a nursing home resident may fall victim to abuse or negligence.
Unexplained marks and bruises may be most obvious, but also be aware of weight loss, withdrawal from activities, generally unkempt appearance, bed sores, unexplained infections among others. Recognizing these signs is a critical part of ensuring your loved one is in a safe nursing home environment.
