8/30/18 Failure to honor the resident’s right to request, refuse, and/or discontinue treatment, to participate in or refuse to participate in experimental research, and to formulate an advance directive. The facility had failed to ensure a resident’s wishes to be a Do Not Attempt Resuscitation were updated in their electronic medical records for the resident’s physician, creating the risk that the resident would be given life-sustaining treatment against their will in the event of a life-threatening emergency.

8/30/18 Failure to protect each resident from all types of abuse such as physical, mental, sexual abuse, physical punishment, and neglect by anybody. The facility neglected to notify a physician and oncoming staff of a new fracture and to control severe pain after a resident fell. The resident suffered a whole night with severe pain after her fall before staff arranged for transportation to the emergency room.

8/30/18 Failure to develop and implement a complete care plan that meets all the resident’s needs, with timetables and actions that can be measured. The facility failed to develop a comprehensive care plan for four residents. One resident was reported to wander the halls and into other residents’ rooms daily, with no care plan in place to prevent this behavior. A second resident was observed smoking without required supervision, with no care plan to address the resident’s smoking. Finally, two other residents were observed to each have a contracted hand due to stroke, with no care plan in place to treat their contractures.

Finding the Best Nursing Home

Choosing a nursing home for a family member can be overwhelming. You want a safe environment with well-trained staff and comprehensive services to meet all your loved one’s individual needs. So how do you find such a facility?

Start by exploring the nursing homes in your community. You can do an internet search to identify these or ask trusted acquaintances or your relative’s doctor or social worker for recommendations. You can also use the internet to look up news reports, reviews, and ratings for specific nursing homes. Medicare.gov, for example, is a great resource to find government ratings and health inspection reports.

After you’ve pinpointed some promising facilities, request tours of each. Visiting in person allows you to observe the environment, staff, and other residents of each location and ask questions pertinent to your loved one’s care. You can also stop by unannounced to see how each nursing home functions when it’s not expecting visitors. Also feel free to stop in or call if you have more questions after your first visit.

When you’ve gathered all the information you can about your options, share and discuss your findings with your relative and any other decision-makers. Together you can compare the different facilities you’re considering and decide which nursing home is the best fit for your elderly loved one’s situation. When you’ve made a choice, begin the process to secure a bed and move your relative in.

It can be a long process, but doing your due diligence to research and consider all options will increase your chances of picking the best nursing home for your family member and reduce their risk of meeting with some harm while there.

Protecting Your Loved One in Assisted Living

Now that you’ve picked a highly-rated nursing home, you can relax a little. But only a little. Unfortunately, the quality of care in assisted living can slip at any time. It only takes one unethical staff member or accident to seriously harm a vulnerable resident. That’s why it’s important for families and friends of residents to stay in close contact and monitor their loved one’s care.

Once your family member has moved into assisted living, visit and communicate often so you can observe their living conditions and personal well-being. Being readily available will help them be able to report anything inappropriate that they experience. Unfortunately, vulnerable residents are often unable to recognize or report abuse and neglect, so they must rely on you to do so. There are many signs of abuse, but here are a few to keep in mind when you visit:

  • Untreated severe bedsores
  • Unexplained injuries like bruises, burns, or scars
  • Evidence of poor circulation like sunken cheeks or eyes
  • Weight loss or malnourishment not due directly to an illness
  • Frequent trips to the emergency room or doctor
  • Wrong type or the wrong amount of medication administered
  • Poor hygiene or unwashed clothes or hair
  • Instances of wandering or elopement
  • Frequently misplaced or lost personal items
  • A lack of basic necessities, including utilities, water, and food
  • A dirty room or bathroom
  • Frequent trouble sleeping
  • Unusual violent or withdrawn behavior
  • Sudden depression or confusion
  • Signs of trauma like rocking back and forth

If you observe any gaps in care or alarming changes in behavior in your loved one after they move into a nursing home, report it to staff immediately. Document anything you experience that seems wrong and take it to the facility management. They should hear you out and take immediate corrective action, but if they fail to do so and you see no effort being made to fix the issues you’ve reported, you may need to take legal action.
