Who May Be Liable for a Child’s Birth Injury?

There are a lot of healthcare team members who can potentially be responsible for a child’s brain injury.
There are labor and delivery nurses who play a part.
There are midwives.
There are residents who work in hospitals.
Sometimes there are family practitioners.
There are also specialists, perinatologists, maternal fetal medicine doctors, all of those.
Specialists at one time or another are involved in taking care of pregnant moms and so when we look at a case where we believe that a child suffered an oxygen deprivation injury, we look at the care that was provided by everyone who came in contact with mom, and then we can look at the care to determine whether appropriate decisions were made.
In terms of how to manage the pregnancy, choosing the best time to deliver, all of that plays a big part.
