Cataract surgery is considered a safe procedure and it is performed thousands of times a day across the country. Yet, sometimes even a routine surgery can be harmful if the doctor is negligent. A man filed a lawsuit in Cook County alleging that his cataract surgery was botched when the doctor implanted an incorrect lens. The lawsuit was filed naming Elmhurst Outpatient Surgery Center, LLC, Westchester Eye Surgeons, S.C., and the doctor who performed the operation. The paperwork filed states the man suffered severe injury because of medical malpractice.

Cataract Surgery

Cataracts are cloudy deposits that develop on the eye lens and are very common in the elderly. They are removed and replaced with artificial lenses with cataract surgery. Cataract surgery has come a long way in the last several decades. Today, cataract surgery is considered routine and is usually quite successful. While there are potential risks involved in any type of medical procedure, the risks involved with cataract surgery are minimal. In this case, the wrong implant was used in the surgery. This caused the man to have to undergo additional corrective surgeries and expensive medical treatment.

Medical Malpractice

In this case, the man underwent cataract surgery, however, claims that the surgery was performed improperly. Further, he states that the doctor did not provide the necessary after-care and did not monitor his condition. The man suffered a permanent eye injury as a result of the medical malpractice, causing him to have to spend quite a bit of money on corrective treatments and surgery. He also was unable to work, causing lost wages. Doctors, surgeons, and other medical professionals are required to provide proper care. In this case, the lawsuit claims that the doctor was negligent and did not properly care for the patient, causing severe injury. The lawsuit seeks damages of more than $50,000.

What to Do After a Serious Injury

If a serious injury was caused by the negligence of a doctor it is called medical malpractice. The doctor is held to a higher standard of care and knowledge based on his position. Those who were injured because of malpractice deserve compensation for any losses they incurred as a result. Medical costs, lost wages, future treatments, money for pain and suffering, and legal fees are all examples of damages that may be paid to those who were harmed because of medical malpractice. There are time limits in place that require you to file a lawsuit quickly, usually within two years of the incident.
